Court challenge: The proposed replacement for Hendo's Hole
A rival Queenstown developer is challenging the consent approval for a new $120 million shopping precinct near Frankton. 

A resource consent was granted this week for plans by Auckland developer Tony Gapes’ Queenstown Gateway (5M) Ltd to build seven major buildings on the site dubbed Hendo’s Hole. 

Shotover Park Ltd, which owns land neighbouring and is a subsidiary of Alastair Porter’s Porter Group, has announced it will challenge the consent in the High Court. 

“SPL has to date resisted lodging judicial review proceedings in the hope that [Queenstown Lakes Development Council} would ensure that the matter be notified for public submissions before reaching a decision as to whether or not to grant consent,” a statement today (Friday) says. 

“This has not happened and the recent decision continues a process of flawed decision making under the RMA. 

“As a consequence, SPL has resolved to lodge judicial review proceedings in the High Court challenging the Council's decision making process.” 

Shotover Park Ltd’s statement claims the Queenstown Gateway application is in effect a de facto plan change which doesn’t comply with the district plan. 

The application will have adverse transportation effects which have not been addressed, the statement adds. 

Council communications boss Meaghan Miller says as the matter is to go before the High Court it is inappropriate for council to make any comment.

The company that just wasted heaps of land in Frankton that should be used for industrial purposes with a supermarket then thinks that someone with the correct zoning for what they are doing ( retail) should be publically notified. Just get on with using your own zoning in Remarkables Park and leave the rest of the retail community to get on with what they are doing. Why don't QLDC tell the Porter group to go and jump??? Oh thats rights Mr Porter is the head of Chamber of Commerce so no one would dare.
